Areas of Practice

Mitchell practises largely in commercial, employment and common law with a particular focus on:

  • unfair dismissal, general protections, workplace discrimination and underpayment claims;
  • personal injury matters; and
  • contractual and consumer law disputes.

He also regularly accepts briefs in criminal law, particularly in occupational health and safety. And recently appeared unled for the employer in the successful appeal of DPP v JCS Fabrications Pty Ltd and Anor [2019] VSCA 50 which resulted in a nolle prosequi.

Experience

He has appeared unled in both jury and judge alone trials.

Before coming to the Bar, he was Associate to Judge Misso at the County Court of Victoria. He assisted his Honour with common law and criminal trials, serious injury applications, pleas, appeals and interlocutory hearings.

Education

Mitchell holds a Bachelor of Laws (First Class Honours) and was recognised as the most outstanding law graduate. He is an Associate of the Chartered Institute of Arbitrators, has lectured at Victoria University and has completed a Master of Laws.
